1. Validity of General Terms and Conditions
The following Terms and Conditions apply to all services provided by SYLA Travel Sim, hereinafter referred to as SYLA, in connection with the resale of eSIM prepaid cards. The following Terms and Conditions are available on the website www.syla.one and the official SYLA Travel Sim application on Google Play, AppGallery and Apple Store. SYLA can only accept derived clauses if explicitly agreed in writing.
2. Description of Services
2.1 Services Offered by SYLA
SYLA is currently offering a wide range of mobile services including:
- Mobile data plans for users who have eSIM supported mobile.
- Full eSIM Profile that contains mobile data and eSIM Numbers.
Products/Services will be displayed on SYLA's official website www.syla.one and mobile apps on Google Play, AppGallery and Apple Store.
2.2 Registration for Using SYLA Services
All customers must accept the General Terms and Conditions in order to use SYLA's services. During the registration process, the following information must be provided:
- Personal information such as first name, last name and email address is required for direct interactions and transactions on the SYLA website (https://www.syla.one) or via the SYLA Travel Sim application.
- ID or Passport copy and proof of address for specific users who are buying any of the services that require providing such information by the telecom operator or the telecom regulatory within specific countries.
In order to adapt to changing service requirements and improve the user experience, SYLA reserves the right to collect additional information from customers as necessary. This collection of additional information will be carried out in a manner that respects privacy and complies with data protection laws, without requiring any further amendments to these General Terms and Conditions. Customers will be informed accordingly of the collection of such additional information via our standard communication channels.
2.3 Quality of Provided Service
SYLA is required to provide the maximum reliable direct and indirect quality service to Customer; however, SYLA does not guarantee the quality service won't be subject to interruption from the resource (Mobile Operators, Telecom Providers and Aggregators), expiry, safety breach or be completely flawless due to internal or external factors.
If in case of faulty service, SYLA is still required to provide maximum support, repair or fix to the concerned Customer.
2.4 Limitation of Liability
SYLA shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, revenue, or business opportunities, resulting from the use or inability to use its services. The Customer acknowledges that the use of the service is at their own risk and that SYLA's total liability under these Terms shall not exceed the amount paid by the Customer for the services during the three (3) months prior to the event giving rise to such liability.
2.5 Customer Usage of Service
While using SYLA's services, the Customer must not misdeed its usage in any abusive or illegal actions that may cause harm, damage, fraud or offense to the brand, service, network or others.
When Customer does not comply with usage obligations under Section 2.4, SYLA is rightful to investigate Customer account internally or with the reliance of a 3rd party, and accordingly rules to either end the Customer service/product, suspend or charge the Customer. Until a decision is taken on the case, the Customer will continue to pay and benefit from SYLA's services.
The suspected Customer will be clearly notified of the fault and reason of rule through a notification sent to his SYLA APP account.
SYLA can terminate and deactivate any of its services assigned to the user due to a misdeed or abusive service usage, anytime without a pre-notification.
2.6 Accepted Use of Service
Customer agrees to use the Services and Websites only for purposes permitted by this Agreement as well as any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
Customer shall not use the Service or authorize the Service to be used directly or indirectly, to transmit Inappropriate Content. Inappropriate Content includes but is not limited to unsolicited material, spam, obscene and sexually explicit material and content that violates Applicable Law, or constitutes hate directed at an individual or a group based on race, sex, national origin, religious affiliation, sexual orientation or language of such individual or group.
Customer shall not use the Service to perform unusual calling patterns inconsistent with normal, individual use, where normal use is, for example, regular calls of short duration or calls to multiple numbers in a short period of time; or sending junk or bulk messages, or any other high volume multiperson calling or messaging purposes.
Customer shall not use the Service to engage in unusually high usage of the Services from individual accounts or employ any automated programs such as bots or clones (non-person-to-person communications) that may impair our ability to provide the service to other customers and/or indicate misuse of the service.
The Customer is prohibited from using the Service for callback calls, auto-dialing, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation or polling, unsolicited or unauthorized advertising or spam), fax or voicemail broadcasting or fax or voicemail blasting purposes.
Any attempt to do any of the foregoing is a violation of our rights. If You breach this restriction, you may be subject to prosecution and damages and we may, at our sole discretion, terminate your license and bar you from accessing the Services.
3. Contract start, duration and cancellation
3.1 Device Compatibility
Customers must own an eSIM supported mobile device in order to benefit from SYLA mobile data service. SYLA is not responsible for wrongly purchased or non-activatable purchase on a non-eSIM device after downloading the eSIM profile which takes place once the user scans the QR code; the list of eSIM supported mobile devices are displayed during the purchase process; the user will also need to agree manually that he owns an eSIM supported mobile.
A list of eSIM mobile devices can be consulted on the SYLA website and mobile application. However, the list is not exhaustive, which means that recently released eSIM-compatible devices may not yet be included.
3.2 Service Activation
The service contract between SYLA and the Customer begins at the end of the order on the website or application. Service activation varies according to the type of service, as follows:
- eSIM numbers: activation takes place automatically once the phone number has been assigned to the user.
- Mobile data: SYLA provides the user with a QR code; when the user scans the QR code, the eSIM profile is downloaded and partitioned on the user's mobile; actual data activation takes place when the user connects to the mobile operator.
Activation of the SYLA services mobile data plan depends on the customer's compliance with the instructions provided, which also determine the activation and expiry times for the service purchased, depending on the duration of the plan purchased. The activation manual and service information can be consulted on the https://www.syla.one website or the SYLA Travel Sim application.
3.3 Service Cancellation
Cancellation of service applies to subscription-based products.
The service will be cancelled by default on the expiry date. The user may request a monthly subscription if he/she wishes to renew the subscription.
4. Charges and Payment
4.1 Payment Conditions
SYLA offers a variety of payment methods for its services, including, but not limited to, credit/debit card, PayPal, Google Pay, Apple Pay.
The currency of payment is mainly the US dollar ($) and the Euro (€) and may include various other currencies, the currency of payment being determined during the transaction.
The credit card transaction will be processed and secured by SYLA's approved payment service providers selected by SYLA for each transaction.
It is important to follow the rules and the Terms of Use according to the used payment method.
4.2 Customer Ownage of Service
The customer becomes the owner of the purchased services immediately after the payment process goes through to SYLA.
Customers can display, manage and activate purchased services from the ""Home"" tab on SYLA website and/or app.
4.3 Refund Policy
Since eSIMs are digital products, no refunds are issued once the QR code is delivered, unless one of the following applies:
- Technical error preventing activation (evidence required)
- Duplicate payment
- Incompatibility not disclosed in the product description
Refund requests must be submitted within 7 days of purchase with supporting documentation.
4.4 Customer Privacy
SYLA is able to collect Customer data from and after registration. All data provided by consent from the Customer will be protected.
Exchanged data between SYLA APP and the servers are all encrypted using SSL, this is done to ensure safe data transportation.
5. Divers
The original English version of these Terms may have been translated into other languages. The translated version of these Terms is a courtesy translation for office use only and Customers may not derive any rights from the translated version. In the event of any dispute as to the content or interpretation of these Terms or in the event of any conflict, ambiguity, inconsistency or discrepancy between the English version and any other translated version of these Terms, the English version shall apply and prevail and shall be conclusive and enforceable. The English version shall be the version used in legal proceedings. If any provision of these Terms is or becomes invalid or unenforceable, you will continue to be bound by all other provisions described herein. In such event, such invalid provision shall nevertheless be enforced to the fullest extent permitted by applicable law and each party shall at least agree to accept a similar effect to that of the provision deemed invalid, unenforceable or non-binding, taking into account the content and purpose of these Terms.
6. Governing Law and Jurisdiction
The use of our Services shall be governed in all respects in accordance with the laws of the EU.
Users shall not use the Connectivity Services and the Mobile Services in any manner or for any purpose, which constitutes a violation of the laws of the EU.
Users shall fully comply at all times in connection with and throughout the course of the provided Service with all applicable laws, statutes, regulations and codes in relating to combating corruption, including in all cases the appropriate provisions of the EU Foreign Corrupt Practices Act, and the rules and regulations.
By using SYLA's services or by creating an account on the SYLA application or website, you confirm that you have read, understood, and accepted these Terms and Conditions in full.
